Terms of Service
These Terms of Service (the "Terms") set out the conditions for using the game "Hanafuda Solitaire" (the "Game") provided by TKG (Tamago Kake Gohan) ("we", "us"). By obtaining or using the Game, you agree to these Terms.
1. Scope
These Terms apply to every version of the Game:
- The app versions (iOS / Android)
- The Steam version
- The browser version (demo, hanafuda.tkgsoft.com)
- Pre-release test versions provided for beta testing
How we handle information in the Game is described in our separate Privacy Policy.
2. Relationship with store terms
- Purchases, payments and refunds of the Game are governed by the terms and policies of the store where you bought it (App Store, Google Play or Steam). We never receive payment from you directly.
- If you obtained the Game from the App Store, Apple's Licensed Application End User License Agreement also applies. Where it conflicts with these Terms, that agreement prevails for the App Store version.
3. License
We grant anyone who has lawfully obtained the Game a non-exclusive, non-transferable right to use the Game for personal enjoyment. Videos, streams and screenshots under Section 5 may also be used to earn money.
4. Ownership
- All rights in the Game's program, design, text and other works belong to us or to their rightful owners. These Terms do not transfer any of those rights to you.
- The Game contains materials provided by third parties (card images, fonts, music, sound effects, etc.). Those materials are subject to the terms set by their respective owners. The main materials and their terms are listed on the Game's credits screen.
5. Videos, streaming and screenshots
You are free to post gameplay videos, stream the Game live and share screenshots without asking us first. You may also earn money from them through the standard features of video and streaming platforms (ads, tips, memberships and the like).
- We'd appreciate it if you mention the title ("Hanafuda Solitaire") in your video or stream description.
- Please don't present your content in a way that suggests it is official content from us.
- Please don't extract the Game's music for other use, or make videos whose main purpose is to let viewers listen to the music while the game screen plays (such as background-music videos for studying or working).
- For test versions, follow the instructions given for the test before publishing videos or screenshots.
6. Prohibited conduct
When using the Game, you must not:
- Copy the Game or any part of it (including its materials) to distribute, sell or rent it
- Extract materials from the Game and use them for purposes unrelated to the Game
- Modify, decompile or disassemble the Game, except as permitted by law
- Transfer or share test versions, or keys or invitations given to you for testing, with anyone else
- Act against the law or public order and morals
- Otherwise infringe our rights or the rights of others
7. Demo and test versions
We may change the browser version (demo) and test versions, or stop providing them, without notice. Test versions are under development and may contain bugs.
8. Save data
The Game's save data is stored on your device (except where you use a platform's backup feature, such as Steam Cloud). We do not keep your save data, so we cannot restore save data lost through device failure, switching devices, deleting the app or the like.
9. Updates and end of sales
We may update the Game or stop selling it on a store. Even after sales end, you can keep playing a copy you have already obtained, to the extent each platform allows.
10. Disclaimer
- We do not warrant that the Game is fit for any particular purpose, runs on every device, or is free of bugs.
- Where we are liable for damage you suffer in connection with the Game, our liability is limited to the amount you paid to purchase the Game, except in cases of our intent or gross negligence.
- Nothing in these Terms limits any rights you have under the Consumer Contract Act of Japan or other laws (including the laws of the country or region where you live) that cannot be limited by contract.
11. Changes to these Terms
We may change these Terms when necessary. If we do, we will publish the new Terms and their effective date on this page before they take effect.
12. Governing law and jurisdiction
These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction in the first instance over any dispute relating to the Game. This does not prevent you from bringing proceedings in a court available to you under the laws of the country or region where you live.
